Working Direct With Clients

A Professional Approach to Resolving Complex Financial Matters

Much of my work involves couples with substantial or complex financial arrangements, and accordingly many of my clients come to mediation through their solicitors.

However, you are also welcome to approach me directly if you do not yet have legal representation, or if you would like mediation to be the first step in resolving matters.

Constructive Resolution

Efficient Mediation Supported by Expert Advice

Where appropriate, each of you will be advised to obtain independent legal advice alongside the mediation process and is likely to be something I encourage. It is often helpful and ultimately saves time in cases involving significant assets or more complex financial structures. If legal advice is considered necessary, I can help you identify an appropriate adviser if needed.

My aim throughout is to provide a focused, efficient process that helps couples reach practical financial agreements, avoiding the cost, delay and stress that often arise when matters proceed through contested court proceedings.

The First Steps

How the Mediation Process Begins

1.

Your Initial MIAM Meeting

The process begins with an individual meeting with me known as a MIAM (Mediation Information and Assessment Meeting). For convenience and flexibility this meeting is usually held online.

2.

Assessing Suitability

During the MIAM we will discuss your circumstances, consider whether mediation is suitable, and decide whether we are the right fit to work together. Assuming so, a similar meeting will then be held with your partner

3.

A Voluntary Process

Mediation is a voluntary process, so it is important that everyone involved feels comfortable that the process is the right choice.

4.

Beginning the Joint Process

If mediation is appropriate, we can then begin working together. I will explain what financial information will need to be gathered by you and your partner. In our first joint session we will focus on establishing how we will work together effectively. I will also invite each of you to reflect on your priorities and the outcomes you would like to achieve through mediation.

How I Work

A Committed and Flexible Approach to Mediation

  • A.

    How I Approach Mediation

If we agree to work together, I expect everyone involved to commit to making the process a success.

Some people approach mediation thinking they will simply “give it a go”, but in my experience it works best when both parties are genuinely committed to reaching a resolution.

I work with couples who want to settle matters constructively, and with the right approach mediation should achieve that outcome.

I see mediation as a “one stop shop”. If challenges arise during the process, I know the methods — and the professionals — that can help ensure that all issues are resolved within the mediation process, rather than moving to alternative routes which often lead to similar outcomes but at significantly greater cost.

    Where Mediation Takes Place

We will also decide on the most suitable location and format for the mediation sessions. Through my previous role as a partner at Paris Smith LLP, I have access to professional meeting facilities in Bournemouth, Southampton and Winchester, providing a discreet and comfortable setting for mediation.

I am also flexible about venue. If you have them, sessions can take place at one of your solicitor’s offices or at your barrister’s chambers where counsel has been instructed. Many legal professionals strongly support mediation and are usually very willing to accommodate the process.

This flexibility means mediation can take place at a variety of locations across the country, subject to prior agreement. If required, a neutral venue such as a serviced office can also be arranged, with any additional venue hire or travel costs always discussed and agreed in advance.

How We Meet

Online or In Person to Suit Your Circumstances

Mediation can also take place online where appropriate. This can offer convenience, particularly where you and your partner are in different locations or have demanding professional commitments.

However, like most mediators I find that in-person meetings can often be more effective when dealing with complex financial issues. The format that works best for your circumstances will be discussed and agreed before the mediation begins.
